Welcome to Archistics Apparel. Archistics Apparel ("we," "us," or "our") owns and operates this website (the "Site"). By accessing or using the Site, you agree to comply with and be bound by these Terms of Service ("Terms"). These Terms incorporate the Archistics Intellectual Property Policy (the "IPP"). In the event of any inconsistency between these Terms and the IPP, these Terms of Service shall prevail.

1. Online Store Terms

You agree not to use our products or services for any unlawful or unauthorized purpose, including the violation of intellectual property or privacy laws. You must not transmit any worms, viruses, or code of a destructive nature. A breach or violation of any of these Terms will result in an immediate termination of your Services.

2. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (excluding credit card information) may be transferred unencrypted over various networks. Credit card information is always encrypted during transmission. You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Service, including our monthly "Architecture" drops, without express written permission from us.

3. Accuracy and Timeliness of Information

We are not responsible if information made available on this Site is not accurate, complete, or current. The material on this Site is provided for general information only and should not be relied upon as the sole basis for making decisions. Any reliance on the material on this Site is at your own risk. We reserve the right to modify the contents of this Site at any time, but we have no obligation to update any information on our Site.

4. Products & Services

Certain products, such as our "Arch. Collection", may be available exclusively online through the Site. These products or services may have limited quantities and are subject to return or exchange only according to our Returns & Care Policy. We have made every effort to display as accurately as possible the colors and images of our products. We reserve the right to limit the sales of our products or services to any person or geographic region.

5. Delivery & Shipping

• Delivery: We cannot guarantee specific delivery dates. Final delivery is handled by third-party carriers. Ownership of the products passes to the customer once we deliver the items to the carrier at our shipping point.
• Shipping: Risk of loss and title for the products transfer to the customer upon delivery to the carrier. For missing packages marked as "delivered," the customer is responsible for filing a claim directly with the carrier. Archistics Apparel will not issue a refund or resend products in these instances.

6. Billing & Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

7. User Comments & Submissions

If you send creative ideas, designs, or plans (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, and distribute them. You retain ownership of specific User Content (designs/artwork) uploaded for custom production, granting Archistics Apparel a non-exclusive license solely to fulfill and deliver your requested products.

8. Prohibited Uses

You are prohibited from using the Site or its content for any unlawful purpose, to solicit others to perform unlawful acts, or to infringe upon our intellectual property rights. We reserve the right to terminate your use of the Service for violating any of the prohibited uses, including harassment, abuse, or the submission of false information.

9. Disclaimer of Warranties; Limitation of Liability

We do not guarantee that your use of our service will be uninterrupted, timely, secure, or error-free. You expressly agree that your use of, or inability to use, the service is at your sole risk. In no case shall Archistics Apparel, our directors, officers, or employees be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind.

10. Dispute Resolution & Governing Law

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be resolved through the courts of the Province of Alberta.
